This extended warranty (the “Extended Stick Warranty”) for the purchased composite hockey stick (the “Product”) is governed by these terms and conditions and constitutes an agreement between Zister Group Warranties Inc. and you.

WHAT IS COVERED: This Extended Stick Warranty provides for the replacement of a one piece stick in the event the Product experiences a breakage. If your claim is approved, a voucher will be issued to you for the purchase price for the Product, excluding taxes, as indicated on your sales receipt or order confirmation email, to return to the retailer to purchase a replacement product. Once you have received replacement product pursuant to this Extended Stick Warranty, all of our obligations under this agreement shall have been fulfilled in their entirety.
Limitations and Exclusions: This Extended Stick Warranty does not cover: (i) cosmetic issues such as chips, dings, scratches and grip wear, (ii) promotional or demo products (ex. free product / camp giveaway / demos, etc.), (iii) used / pre-owned products, (iv) products sold as pro stock, (v) products that have been repaired, (vi) products that are not covered by a manufacturer’s original warranty, (vii) intentional physical damage, neglect (e.g., prolonged exposer to inclement weather), misuse (e.g., product use on concrete or asphalt), abuse, alteration, deception, and deface, (viii) loss and theft, and (ix) products with altered or missing serial numbers. Note: There is no coverage for wood or foam core sticks or replacement blades.
For the Product:
To Make a Claim: If you experience a breakage of your Product, please submit a claim through our website at http://www.zippyswarranty.com. You will be required to submit the following three images: (i) Image 1: image of the receipt clearly showing both the stick serial number and purchased Extended Stick Warranty, including white serial number sticker and black serial number on the shaft of the Product, (ii) Image 2: image of the full stick showing black serial number and the break area clearly, and (iii) Image 3: image of the breakage area on the stick.
Claim Process: Once your claim for is complete, we will inspect images of the damaged Product to determine if the damage was caused by normal use or if the coverage is excluded pursuant to the limitations and exclusions provided herein. Do not physically ship any damaged product to us unless you have been asked to do so. If your claim meets our Extended Stick Warranty requirements, we will send you a return authorization number (RA) within five (5) business days along with instructions on what to do with the damaged Product. If we determine that the product is covered by this Extended Stick Warranty, then a voucher will be provided to you to be used toward the purchase of another stick. Note: We reserve the right to refuse the warranty service to any person who, in our sole discretion, abuses the Product or this Extended Stick Warranty.
Delays: We will exercise reasonable efforts in providing a prompt response to your claim under your applicable Extended Stick Warranty, but we will not be liable for any damages arising out of delays in providing such response.
Limitation of Liability: IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE COST OF REPLACEMENT OF THE PRODUCT. IN NO EVENT WILL WE OR ANY OF OUR AFFILIATES, EMPLOYEES, OFFICERS, DIRECTORS OR AGENTS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY BREACH OF THESE TERMS.
Manufacturer’s Liability: Services covered during the manufacturer’s conventional warranty period are the sole responsibility of the manufacturer.
Access and Use of Website. By accessing or otherwise using our website, you hereby confirm that you have read our website’s Terms of Use and Privacy Policy, and agree to be bound by these terms and conditions.
Governing Law: This agreement shall be governed by and construed in accordance with the laws of Province of Ontario, Canada without regard to the choice-of-law principles thereof that would result in the application of the laws of a Province other than Ontario.
Choice of Forum. Any legal suit, action, litigation or proceeding of any kind whatsoever in any way arising out of, from or relating to this agreement, shall be instituted in the courts of the Province of Ontario, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action, litigation or proceeding.
